BH Navigation – Terms & Conditions

Effective Date: February 20th, 2026

Please read these Terms and Conditions (“Terms”) carefully before using the BH Navigation website or BH Navigation Screener (collectively, the “Services”). By accessing or using the Services, you affirmatively agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Services.

1. Purpose of the Services

The BH Navigation Screener is an educational and informational tool developed to help users explore behavioral and mental health resources that may align with their self-reported symptoms, insurance status, location, and stated needs.

The Services are intended solely to support self-reflection and resource navigation and are not a substitute for professional medical or mental health care.

2. No Medical or Psychological Advice

The information provided through the Services is not intended to constitute, and does not constitute, medical, psychological, or mental health advice, diagnosis, treatment, or professional services of any kind. The Services do not replace consultation with qualified healthcare professionals.

You should always seek the advice of a qualified medical or mental health professional regarding any health condition or treatment. Never disregard or delay seeking professional care because of information obtained through the Services.

3. Emergency Situations

BH Navigation is not designed for use in emergencies.

If you believe you or someone else may be experiencing a medical or mental health emergency, call 911 immediately or contact your doctor, local emergency services, or a crisis hotline right away. For immediate mental health crisis support, you may also contact the 988 Suicide & Crisis Lifeline by calling or texting 988.

4. No Provider–Patient Relationship

BH Navigation is not a healthcare provider. Use of the Services does not create a doctor-patient, therapist-patient, or other clinical relationship between you and BH Navigation or any individual involved in developing the Services.

Some features of the Services may help you identify or connect with licensed professionals or organizations. Any relationship you establish with a third-party provider is entirely independent of BH Navigation.

5. No Endorsement or Referral

BH Navigation does not:

  • Refer, recommend, or endorse any specific provider, treatment, test, opinion, or service

  • Guarantee the availability, quality, accuracy, or appropriateness of any third-party resource

You are solely responsible for verifying the credentials, licensing, insurance participation, and suitability of any provider or resource identified through the Services.

6. Assumption of Risk

You acknowledge that behavioral and mental health screening tools involve inherent uncertainty. You assume full responsibility for:

  • All decisions made based on screener results

  • Any actions taken or not taken

  • Any provider selected through third-party listings

BH Navigation does not guarantee accuracy, completeness, timeliness, or suitability of any output.

7. Eligibility

The Services are intended only for individuals 18 years of age or older.

By using the Services, you represent and warrant that:

  • You are at least 18 years old

  • You have the legal capacity to agree to these Terms

Use of the Services by minors is strictly prohibited.

8. Privacy and Data Use

The Services may collect information you voluntarily provide, including potentially sensitive mental health-related information.

BH Navigation does not operate under HIPAA as a covered entity or business associate and does not provide clinical care through the Services. However, certain information you provide may be subject to Washington's My Health My Data Act (RCW 19.373) and will be handled in accordance with that law.

By using the Services, you acknowledge and agree that:

  • You are submitting information voluntarily

  • Your information may be used to generate screening results and resource matches

  • Reasonable safeguards are used, but no system can guarantee absolute security

A separate Privacy Policy is incorporated herein by reference and is available below. Your initial access to and use of the Services constitutes acceptance of the Privacy Policy. Continued use of the Services after any updates to the Privacy Policy will constitute acceptance of the revised terms. BH Navigation will use commercially reasonable efforts to provide notice of material changes through the Services interface or by email to your last known address, but failure to receive such notice does not affect the validity of the revised Privacy Policy upon publication.

9. Third-Party Links and Content

The Services may include links to third-party websites or information provided by third parties. These websites are maintained independently of BH Navigation.

BH Navigation does not control, endorse, or assume responsibility for:

  • Third-party content

  • Accuracy or completeness of external information

  • Privacy practices of other websites

When you leave the BH Navigation website, you are subject to the terms and policies of the third-party site.

10. Intellectual Property

All content on the BH Navigation website, including text, graphics, logos, trademarks, design elements, and software, is owned by BH Navigation or its licensors and is protected by intellectual property laws.

You may download or print materials for personal, non-commercial use only, provided all copyright notices remain intact. Any other use requires prior written permission.

Trademarks include:
“BH Navigation,” the BH Navigation logo, “Trailblazing Healthy Futures,” and “Forjando Futuros Saludables.”

12. Indemnification

To the extent permitted by Washington law, you agree to defend, indemnify, and hold harmless BH Navigation and its directors, officers, employees, contractors, affiliates, and agents from and against any and all claims, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use or misuse of the Services

  • Your violation of these Terms

  • Your violation of any law or third-party rights

  • Any content or information you submit through the Services

13. Limitation of Liability

To the fullest extent permitted by law, BH Navigation and its directors, officers, employees, contractors, and agents shall not be liable for any:

  • Indirect

  • Incidental

  • Special

  • Consequential

  • Exemplary

  • Punitive damages

Including but not limited to loss of profits, data, goodwill, or business interruption arising out of or related to use of the Services.

In no event shall BH Navigation’s total cumulative liability exceed the greater of:

  • One hundred dollars ($100), or

  • The amount you paid, if any, to access the Services within the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability. In such cases, liability shall be limited to the maximum extent permitted under Washington law, and any limitations that cannot be enforced under applicable law shall be deemed modified to the minimum extent necessary to comply with such law while preserving the intent to limit liability.

 14. Modifications to the Services or Terms

BH Navigation reserves the right to modify, suspend, or discontinue the Services, and to update these Terms, at any time without prior notice.

Changes will be effective upon posting or upon such other date as specified by BH Navigation in its sole discretion. BH Navigation may provide advance notice of changes where reasonably practicable. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.

16. Dispute Resolution; Binding Arbitration

Except for claims eligible for small claims court or requests for injunctive relief, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, to the maximum extent permitted by applicable law.

The arbitration shall take place in the State of Washington.

BY AGREEING TO ARBITRATION, YOU AND BH NAVIGATION EACH KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY. YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS WAIVER.

BY AGREEING TO ARBITRATION, YOU FURTHER WAIVE THE RIGHT TO:

  • Participate in a class action

  • Serve as a class representative

  • Seek consolidated or collective proceedings

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction in Washington State, or from bringing claims in small claims court. Additionally, nothing in this arbitration provision waives, limits, or affects any rights you may have under Washington's Consumer Protection Act (RCW 19.86) or other non-waivable consumer protection laws.

17. Washington Consumer Health Data Notice

If you are a Washington resident, information you submit through the Services that relates to your physical or mental health conditions, symptoms, or care preferences may qualify as “consumer health data” under Washington law.

We collect such data solely:

  • To generate screener outputs and resource navigation results

  • To improve Services in aggregated, de-identified form

  • To maintain and secure the functionality of the Services

We do not sell consumer health data. We do not share consumer health data with third parties except: (a) as necessary to provide the Services you requested; (b) with your express written consent; (c) to comply with legal obligations; or (d) as otherwise permitted under Washington's My Health My Data Act (RCW 19.373).

Washington residents may have rights under applicable law to:

  • Confirm whether we collect consumer health data

  • Access such data

  • Request deletion of consumer health data

  • Withdraw consent for collection or sharing

We will acknowledge receipt of your request within ten (10) business days and respond within forty-five (45) days, or as otherwise required by Washington law.

We will respond in accordance with Washington's My Health My Data Act (RCW 19.373) and other applicable Washington law. We will not retaliate against you for exercising your rights under Washington law, including by denying services, charging different prices, or providing a different level of service quality.

18. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

19. User Acknowledgment and Consent

Before accessing screener results, users must affirmatively acknowledge that:

  • The Services are not medical advice

  • The Services are not emergency services

  • No provider–patient relationship is created

  • Information submitted is voluntary

Use of the Services following such acknowledgment constitutes informed consent to data practices described herein.

20. Entire Agreement

These Terms constitute the entire agreement between you and BH Navigation regarding the Services and supersede any prior agreements or understandings.

BH Navigation – Privacy Policy

BH Navigation (“BH Navigation,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and protect information when you use the BH Navigation website and BH Navigation Screener (collectively, the “Services”).

By using the Services, you consent to the practices described in this Privacy Policy.

1. Scope of This Privacy Policy

This Privacy Policy applies only to information collected through the BH Navigation Services.

It does not apply to:

  • Third-party websites or services linked from our website

  • Healthcare providers or organizations you may contact independently

  • Any services provided directly by third parties

2. Important Notice Regarding Health Information

BH Navigation is not a healthcare provider and does not provide medical or mental health treatment.

BH Navigation is not a covered entity or business associate under the Health Insurance Portability and Accountability Act (HIPAA). Information submitted through the Services is not treated as Protected Health Information (PHI) under HIPAA.

Submission of information does not create a clinical record, medical file, or provider relationship.

However, we recognize that some information you voluntarily provide may be sensitive, and we take reasonable steps to safeguard it.

3. Information We Collect

We collect information you choose to provide when using the Services, which may include:

a. Information You Voluntarily Provide

  • Responses to screening questions related to emotional, behavioral, or mental health experiences

  • Demographic information such as age range (confirming 18+), location (e.g., ZIP code or state), and insurance type

  • Preferences or stated needs related to care or resources

You are not required to provide identifying information unless explicitly requested.

b. Automatically Collected Information

When you use the Services, we may automatically collect limited technical information to the extent necessary for service functionality, such as:

  • IP address

  • Browser type and device information

  • Pages visited and interactions with the website

This information is used for security, performance, and basic analytics. We do not use this technical information to identify you individually or to make decisions that produce legal or similarly significant effects concerning you.

4. How We Use Your Information

We use collected information to:

  • Generate screener outputs and resource-matching results

  • Improve the accuracy, usability, and functionality of the Services

  • Maintain website security and performance

  • Understand general usage patterns (in aggregate form only)

We do not use your information to provide medical advice, diagnosis, or treatment. The Services are informational only and do not create a provider-patient relationship.

5. How We Share Information

We do not sell your personal information.

We may share information only in the following limited circumstances:

  • With service providers who help operate the website or technology infrastructure, who are contractually bound to confidentiality obligations and prohibited from using consumer health data for any purpose other than providing services to us

  • If required by law, court order, or legal process

  • To protect the rights, safety, or security of BH Navigation, users, or others

Any shared data is limited to what is reasonably necessary for the stated purpose.

We do not sell, share for targeted advertising, or use consumer health data for profiling or automated decision-making that produces legal or similarly significant effects.

6. Data Storage and Security

Information submitted through the Services is stored using commercially reasonable safeguards within Microsoft Azure cloud infrastructure located in the United States.

We retain individual-level screener responses only as reasonably necessary to:

  • Generate outputs

  • Maintain system integrity

  • Produce aggregated, de-identified analytical dashboards

Aggregated dashboards do not identify individual users and are used solely to understand general trends and community-level needs.

We implement reasonable administrative, technical, and physical safeguards to protect consumer health data from unauthorized access, destruction, use, modification, or disclosure; however, no system can guarantee absolute security. In the event of a breach affecting consumer health data, we will provide notice as required by Washington law.

7. Data Retention

We retain information only for as long as reasonably necessary to:

  • Operate and improve the Services

  • Comply with legal or regulatory obligations

  • Resolve disputes and enforce agreements

Information may be de-identified or aggregated for analytical purposes in accordance with applicable standards. Once properly de-identified, such information is no longer subject to the restrictions applicable to consumer health data.

8. Your Choices and Rights

You may:

  • Choose not to use the Services

  • Limit the information you provide

  • Stop using the Services at any time

At this time, we do not offer user accounts or dashboards to access, correct, or delete submitted information through an automated system. However, Washington residents may exercise their rights by submitting requests as described below. Future features may include additional self-service controls.

Additionally, if you are a Washington resident, certain information you submit through the Services that relates to your physical or mental health conditions or symptoms may qualify as “consumer health data” under applicable Washington law.

We collect and use such consumer health data solely for the following purposes:

  • To generate screener outputs and resource navigation results

  • To improve Services in aggregated, de-identified form

  • To maintain and secure the functionality of the Services

We do not sell consumer health data, except as expressly permitted by applicable law or with appropriate consumer consent where required.

Washington residents may have rights under applicable law to:

  • Confirm whether we collect consumer health data

  • Access such data

  • Request deletion of consumer health data

  • Withdraw consent for future collection or sharing of consumer health data, subject to Service Provider's legal obligations to retain data for completed transactions and compliance purposes

We will use reasonable efforts to respond to verified requests in accordance with Washington's My Health My Data Act, generally within 45 days where feasible. Response times may vary based on the complexity of the request, volume of requests, and other operational factors.

9. Children’s Privacy

The Services are intended only for individuals 18 years of age or older. If you are under 18, you must obtain permission from a parent or legal guardian before using the Services.

We do not knowingly collect consumer health data or personal information from individuals under 18 without parental consent. If we learn that such information has been collected from a person under 18 without appropriate parental consent, we will take prompt steps to delete it and will not use it for any purpose.

10. Third-Party Websites and Services

The Services may contain links to third-party websites or resources.

We are not responsible for the privacy practices, content, or security of third-party websites. Once you leave our website, you are subject to the third party’s privacy policy and terms. We do not share your consumer health data with these third parties unless explicitly stated in this Privacy Policy.
